In Brief

The Madurai Corporation appealed a High Court order directing it to grant extension of time to a respondent to complete a building constructed up to six floors. The building was originally sanctioned for eleven floors, but the respondent gave an undertaking not to construct beyond six floors and agreed to remedy deviations in the construction. The Supreme Court found the issue did not require deciding broad jurisdictional questions. It held that the Corporation should examine the respondent's written request within eight weeks, conduct a survey, verify conformity with the original sanction, and pass an order granting extension and specifying conditions. The respondent may use the building only after formal order and completion certificate."
