The Supreme Court upheld the constitutional validity of Section 305 of the Madhya Pradesh Municipal Corporation Act, 1956, which empowers municipal corporations to remove buildings or parts thereof projecting beyond the regular line of a public street. The appellants challenged this provision as violative of Articles 14, 19, 21 and 300A of the Constitution and as superseded by the Land Acquisition Act, 2013. The Court held that Section 305 provides a special statutory procedure for street line regulation that overrides general acquisition procedures, is based on sound public purpose, and provides reasonable compensation through Sections 306 and 387 of the Act. The Court found no constitutional infirmity and dismissed the appeals."
