In a NEET-UG admission dispute, appellants challenged the transfer of vacant NRI (Non-Resident Indian) quota seats to unreserved seats in Kerala's private medical colleges. The State had rejected the Kerala Private Medical College Management Association's request for extended registration time for NRI applicants, citing COVID-19 pandemic difficulties. The High Court upheld the transfer under the prospectus clause 5.5.4. The Supreme Court dismissed the appeal, holding that since appellants did not challenge the prospectus provisions authorizing conversion of vacant NRI seats, the Court could not decide on their legality. Further, none of the qualifying appellants exercised options for the vacant NRI seats. The rejection of the extension request was based on sufficient prior notice and time given to candidates, with no allegation of mala fide or arbitrariness.
