NILAY GUPTA vs CHAIRMAN NEET PG MEDICAL AND DENTAL ADMISSION/COUNSELLING BOARD 2020 AND PRINCIPAL GOVT. DENTAL COLLEGE & ORS

Bench: 2 — L. Nageswara Rao, S. Ravindra Bhat

In Brief

The Supreme Court addressed whether private medical colleges can eliminate NRI (Non-Resident Indian) quota seats after an admission process has commenced. The Court held that while colleges have discretion to offer or not offer an NRI quota, this discretion must be exercised fairly. Although the colleges could legally withdraw the quota, they could not do so without reasonable notice after candidates had already submitted documents and committed themselves as NRI applicants. The Court directed a limited special counselling session to allocate merit-based NRI seats to eligible candidates who had relied on the quota's availability, while protecting admissions already granted to management quota students. The appeal was partly allowed with specific conditions for remediation in these particular circumstances."
