Mahanagar Telephone Nigam Ltd (MTNL), a public sector enterprise, sought to refer ongoing disputes with Canara Bank to the Administrative Mechanism for Resolution of Disputes (AMRCD) instead of pursuing arbitration. The Court held that when disputes arise between two PSUs, an attempt should be made to resolve them through AMRCD before arbitration. The reference to AMRCD does not constitute a review of prior judgments. The parties remain free to revert to arbitration if AMRCD resolution fails.
