Mallappa Dead by L.Rs. & Ors vs Special Land Acquisition Officer & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

The Supreme Court upheld the land acquisition compensation awarded by a Reference Court rather than the reduced rate set by the High Court. The land, comprising 24 acres 15 guntas in Hubli, was acquired for industrial development. The Reference Court fixed compensation at Rs. 21,000/- per Gunta based on the land's suitable location in a well-developed area with comparable adjacent sales. The High Court reduced this to Rs. 10,250/- per Gunta (applying 30% deduction for development). The Supreme Court restored the Rs. 21,000/- market rate but applied a 10% development charge deduction, fixing final compensation at Rs. 18,900/- per Gunta.
