MAMTA KAUR vs STATE OF PUNJAB

Bench: 2 — Bela M. Trivedi, Prasanna B. Varale

In Brief

Mamta Kaur challenged a High Court decision rejecting her anticipatory bail petition in a Section 306 IPC (abetting suicide) case. The Supreme Court allowed her appeal, holding that since the appellant had cooperated with police investigation and no further custodial interrogation was needed, she deserved bail. The Court directed that upon arrest, she be released on bail subject to such conditions as the Trial Court may impose. The State retains the right to seek bail cancellation if any conditions are violated.
