Manish Kathuria and Others etc. etc vs State of Punjab and Others etc. etc

Bench: 2 — Kurian

In Brief

The appellants sought appointment as Excise and Taxation Inspectors in Punjab after the High Court rejected their petition as delayed. The Supreme Court set aside the High Court judgment and directed their appointment, invoking Article 142 to do complete justice. The Court found that vacancies existed, the candidates were qualified according to a High Court-appointed committee, and no prejudice would result. Appointments were ordered within one month while applying horizontal reservation, with seniority to commence from the actual date of joining. The judgment did not create precedent.
