Manish Kathuria and Others etc. etc vs State of Punjab and Others etc. etc

Bench: 2 — Kurian

In Brief

The Supreme Court set aside a High Court judgment that rejected the appellants' claim for appointment as Excise and Taxation Inspector on grounds of delay. The Court noted that it had itself directed the appellants to approach the High Court during pendency of the special leave petitions, making the delay attributable to the Supreme Court's own directions. Finding that vacancies existed and the appellants were qualified, the Court invoked Article 142 to order their appointment within one month, applying horizontal reservation and fixing seniority from the date of joining. The Court clarified this was a peculiar case and should not be cited as precedent.
