MANISH SISODIA vs CENTRAL BUREAU OF INVESTIGATION

Bench: 2 — Sanjiv Khanna, S.V.N. Bhatti

In Brief

Manish Sisodia, Delhi's former Deputy Chief Minister, sought bail in two parallel prosecutions: one under the Prevention of Corruption Act and Indian Penal Code for alleged conspiracy to frame a new excise policy benefiting liquor wholesalers, and another under the Prevention of Money Laundering Act for alleged use of illicit proceeds for political party funding. The Supreme Court dismissed the bail plea, holding that while the court need only form a tentative opinion on broad probabilities, specific allegations of direct or indirect involvement in proceeds of crime were lacking. The Court noted absence of evidence that bribes were paid to Sisodia personally and non-prosecution of the alleged beneficiary (AAP) as an accused, but acknowledged his prolonged detention and granted liberty to file fresh bail applications if the trial becomes unduly protracted despite prosecution assurances of completion within 6-8 months.
