In Brief

The Union of India had operated the Larsgess Scheme, which allowed certain wards of serving railway employees to enter service without competitive examination. The Punjab and Haryana High Court and Supreme Court found this scheme violated constitutional equality principles (Articles 14 and 16). The Union terminated the scheme in March 2019. Petitioners sought a court order mandating their appointment despite the scheme's termination. The Supreme Court dismissed the petition, holding that no one can claim a vested right under an unconstitutional scheme, and granting the relief would improperly circumvent the constitutionally-justified termination decision.
