Marvel Omega Builders agreed to sell a residential villa to Shrihari Gokhale for Rs.8.31 crores with promised delivery by 31 December 2014. The buyers paid Rs.8.14 crores but the villa was never delivered by the due date. When the dispute was filed, the builder claimed the villa was now ready; however, the Supreme Court upheld the Consumer Commission's order granting full refund of Rs.8.14 crores with 10% annual interest plus litigation costs. The Court held that a five-year delay was inexcusable and destroyed the bargain, justifying the buyers' refund claim despite the property's later readiness."
