Marvel Omega Builders promised to deliver a residential villa to the Respondents by 31 December 2014 but failed to do so. After more than five years and despite the villa finally being completed, the Respondents sought refund of their ₹8.14 crore deposit with interest. The Commission ordered the builder to refund the amount with 10% simple interest and ₹25,000 in litigation costs. The Supreme Court upheld the decision, holding that the five-year delay breached the bargain fundamentally and the respondents were justified in rejecting belated performance. The villa remains attached until the decree is fully satisfied.
