The Jaipur Municipal Corporation appealed against an order directing refund of conversion charges paid by property owners seeking approval for a commercial-cum-residential building on residential land. The owners claimed the charges were improper. The Court held that property owners seeking to develop residential land for commercial use are statutorily obliged to obtain conversion of land use. As the owners themselves sought building plan sanction for commercial use, they were bound to pay conversion charges and cannot claim refund. The appeal was allowed.
