Retired employees of minority colleges affiliated to Bihar universities challenged the State's refusal to extend Triple Benefit Scheme (pension, gratuity, and provident fund) benefits to those who retired before 31 August 2010, while granting them to those retiring after that date. The High Court dismissed their claim. The Supreme Court upheld this decision, holding that the Government had no obligation to extend benefits to employees of affiliated (non-constituent) colleges. When such benefits are voluntarily extended as educational support, the State may reasonably fix a cut-off date based on financial and administrative considerations. Unless shown to be capricious, the cut-off date is not discriminatory.
