In Brief

The State of Uttar Pradesh challenged a High Court judgment that declared Regulation 101 (amended to require outsourcing of Class IV posts in aided schools) unconstitutional. The Supreme Court held that the regulation is valid, being a reasonable policy decision made in 2010 based on financial constraints and efficiency. Aided institutions receiving government aid must comply with conditions attached to such aid, as there is no fundamental right to receive aid. The policy applies uniformly across all departments and institutions. The Court distinguished between minority and non-minority institutions for aid purposes, holding both subject to the same uniform conditions. However, institutions that illegally recruited employees must retain them at the same salary scale, as a matter of justice.
