The Medical Council of India challenged a High Court order staying the Ministry of Health's decision to bar a medical college from admitting students for two years and authorizing encashment of its Rs. 2 crore bank guarantee. The Supreme Court disposed of the appeal by directing: (1) the Ministry to take final decision with assistance of a Hearing Committee; (2) the bank guarantee shall not be encashed pending final decision; (3) MCI to inspect the institute for 2018-19 and allow curing of deficiencies; (4) the 2017-18 application to be treated as 2018-19 application. Students already admitted in 2016-17 may continue studies. The Ministry must decide within one month of receiving MCI's recommendation.
