The Medical Council of India appealed against a High Court order directing it to permit a medical student's transfer from an unrecognized private college (Ananta Institute) to a recognized government college (Dr. S. N. Medical College, Jodhpur). The student had scored only 110 marks in NEET, far below the required cutoff of 560 marks. The Supreme Court held that medical student migration is permitted only when both colleges are recognized under the Medical Council of India Act, 1956. Since the source college was unrecognized, migration was prohibited by Regulation 6(2), and any alleged discriminatory relaxation granted to another student was factually distinguishable. The appeal was allowed and the High Court judgment was set aside.
