Medical Council of India vs G.C.R.G. Memorial Trust & Ors

Bench: 3 — Dipak Misra

In Brief

Medical Council of India challenged a High Court order that permitted a private medical college to admit students for 2017-2018 despite a two-year debarment imposed by the Central Government. The Supreme Court found the High Court had violated judicial propriety by passing the order in direct contravention of the Court's earlier direction not to entertain interim matters concerning that academic session, and without hearing the opposing parties. The Court quashed the High Court's order, barred the admitted students from continuing, ordered the college to compensate each student with ₹10 lakhs plus fee refunds, imposed ₹25 lacs costs on the college, and rejected the college's plea for renewal in 2018-2019, emphasizing that unscrupulous litigants cannot manipulate the justice system.
