In Brief
The Medical Council of India sought to challenge a High Court order in favour of Prasad Education Trust. The respondent-Trust, through senior counsel, took a fair position by stating it did not seek to benefit from the High Court's order except for one relief: that the Medical Council should not encash the bank guarantee. The Supreme Court, appreciating this fair submission, directed that the bank guarantee shall not be encashed and granted liberty to the respondent to approach the Court directly under Article 32 of the Constitution if needed in future.
