In Brief
The Medical Council of India sought special leave to appeal against a High Court order regarding the encashment of a bank guarantee furnished by Prasad Education Trust. The respondent's counsel stated that the Trust sought only to prevent encashment of the guarantee. The Supreme Court, appreciating the fair submission, directed that the bank guarantee shall not be encashed. The SLP was disposed of with liberty granted to the respondent to approach the Court under Article 32 of the Constitution of India for further relief if needed.
