Two civil suits sought declarations challenging an order dated 17.10.1978 passed by the Prescribed Authority under the Haryana Ceiling on Land Holdings Act, 1972. The disputes involved competing claims to 4/5th share in agricultural land in Haryana. The High Court dismissed both suits as barred by Section 26(b) of the Act, which expressly prohibits civil courts from examining the legality of orders passed by the Prescribed Authority. The Supreme Court upheld this decision, holding that the statutory bar on civil court jurisdiction is clear and the appropriate remedy lies in appealing to or seeking revision before the authority itself under Section 18 of the Act.
