Melmaruvathur Adhiparasakthi Institute of Medical Sciences and Research vs Union of India and Anr

Bench: 3 — A.M. Khanwilkar

In Brief

The Supreme Court set aside the order debarring Melmaruvathur Adhiparasakthi Institute from admitting students for 2017-18 and 2018-19, as the Competent Authority had reiterated a ban without proper reasoning based on only an inconclusive recommendation. However, the Court declined to grant immediate relief given serious deficiencies in infrastructure and facilities noted in assessment reports. Instead, it directed MCI to inspect the college within three months, assess corrective actions, and report within a month. If approved, the college may admit 150 students in 2018-19. The bank guarantee remains secured pending the final decision."
