The appellant challenged a municipal notice alleging unauthorized construction in his property. The Municipal Corporation's notice was issued under Section 351 of the Mumbai Municipal Corporation Act, 1888. Two other parties, respondents 2 and 3, who claimed ownership rights in the same property and had a pending suit for specific performance, sought to be made defendants. The Trial Court and High Court allowed their impleader application, holding them proper parties. The Supreme Court reversed, holding that respondents 2 and 3 were neither necessary nor proper parties. The only necessary party for deciding the notice's legality was the Corporation itself. Disputes regarding the property between multiple parties must be adjudicated in separate suits based on their respective causes of action."
