Mohammade Yusuf & Ors vs Rajkumar & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In this civil appeal, the Supreme Court examined whether a compromise decree relating to property required registration under Section 17 of the Registration Act, 1908. The suit involved a dispute over land where the plaintiff claimed title based on adverse possession. The lower court and High Court had required the decree to be registered. The Court held that Section 17(2)(vi) expressly excludes "any decree or order of a Court" from mandatory registration requirements. Therefore, compromise decrees relating to property do not require registration to be valid. The appeal was allowed and the orders of the Civil Judge and High Court were set aside.
