Bench: 3 — Ashok Bhushan, R. Subhash Reddy, M.R. Shah

In Brief

A rape victim with three children, whose identity was publicly disclosed, sought constitutional protection under Article 32 for rehabilitation and basic necessities. The Supreme Court held that rape victims suffer not only mental trauma but also severe social discrimination and are entitled to State support. The Court directed the Deputy Commissioner to ensure free education for her two minor children until age 14, consider housing under Prime Minister Awas Yojana, maintain police security, and facilitate legal aid through the District Legal Services Authority. The petitioner was also noted to have already received compensation under the Jharkhand Victim Compensation Scheme.
