Importantly, a civil appellate court had already conclusively determined that the agreement was genuine, not forged—the very cornerstone of the criminal complaint. The Court held that allowing prosecution when the complaint's foundation has been destroyed by appellate findings constitutes abuse of process. The appeal was allowed and the criminal proceedings were quashed.
