In Brief
The appellants challenged a High Court judgment dismissing their second appeal in a property dispute. After the compromise disposal was challenged, the Supreme Court remanded the case directing the High Court to first decide whether the compromise was legally valid before deciding the appeal on merits. However, the High Court skipped this step and decided the appeal on merits anyway. The Supreme Court held this was error: if a compromise is found legal and proper, the appeal ends there; only if found illegal need the appeal be decided on merits. The Court set aside the High Court's order and remanded for fresh decision, requiring the legality of the compromise to be examined first.
