In Brief
A civil suit was filed seeking a declaration regarding the execution of two sale deeds in favour of Ravinder Kumar. The trial Court and first appellate Court both decreed the suit. However, the High Court set aside both judgments and dismissed the suit. The Supreme Court found that the High Court had ignored vital pleadings, important material evidence, and failed to address questions of law without providing valid reasons to disturb the concurrent findings of fact. The Supreme Court allowed the appeal and remitted the matter to the High Court for a fresh and proper consideration in accordance with law.
