MUNICIPAL CORPORATION, MUNICIPAL CORPORATION OF GREATER MUMBAI vs PANNA MAHESH CHANDRA DAVE

Bench: 3 — N.V. Ramana, Vineet Saran, V. Ramasubramanian

In Brief

The Municipal Corporation of Greater Mumbai challenged a High Court order directing it to allot alternative sites to eleven tenants whose structures were demolished during a road-widening project without due process. The Supreme Court dismissed the challenge, holding that the High Court's findings that demolition was high-handed and structures existed prior to 1961 could not be disturbed. The Corporation had itself conceded the eligibility of seven of the eleven tenants. No grounds existed to interfere with the High Court's order granting alternative accommodation.
