In Brief
Tenement holders of a cooperative housing society were directed by MHADA to vacate their premises to enable redevelopment and slum rehabilitation. The High Court dismissed their writ petitions challenging the evacuation order. The Supreme Court upheld the validity of the evacuation order under Section 95A of the Maharashtra Housing Act but remanded the case to allow the High Court to examine whether the occupants were entitled to additional benefits under the Development Control Regulations and to address concerns about the allotment of land and F.S.I. increases to the developer. The appellants must vacate within eight weeks or face forcible eviction.
