Muniraj R. Kurmi and Ors. Etc vs State of Maharashtra and Ors. Etc

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

This case involved tenement holders challenging eviction orders issued to facilitate redevelopment of a residential area in Mumbai. The Executive Engineer had directed them to vacate premises under Section 95A of the Maharashtra Housing and Area Development Act, 1976, to enable the Cooperative Housing Society to redevelop the area. The High Court dismissed their writ petitions. The Supreme Court upheld the vacate order but remanded the matter for the High Court to examine whether the appellants were entitled to additional statutory benefits under Development Control Regulations. The appellants were given eight weeks to vacate, with unresolved questions reserved for reconsideration."
