Supreme Court of India 2017-04-18 dismissed

Muniyamma and others vs Anitha Vaz

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In this civil appeal, the appellants challenged an order of the High Court granting them leave to appeal under Articles 133 and 134-A of the Constitution. The Supreme Court issued a show cause notice focusing only on whether the High Court's grant of leave was legally valid. The Court held that a Single Judge of the High Court is prohibited from granting such leave. As the Court had confined the notice to this jurisdictional question alone, it declined to examine the substantive merits of the case. The appeal was dismissed on the ground that the grant of leave was invalid.
