A 21-year-old contract worker died when his motorcycle collided with a rash and negligently driven bus in Tamil Nadu. The High Court awarded compensation of Rs. 5,01,500 but omitted to include future income prospects. The Supreme Court held that, consistent with the Constitution Bench's decision in National Insurance v. Pranay Sethi, future prospects of 40% of established income must be added for deceased persons below age 40 on fixed salary. The Court enhanced compensation to Rs. 6,74,300, increasing the loss of dependency head from Rs. 4,32,000 to Rs. 6,04,800 with 9% interest, and directed the Transport Corporation to deposit the additional amount within eight weeks.
