A motor vehicle accident on 14 September 2013 caused the death of Narinder Sharma, a 42-year-old self-employed businessman. The Motor Accident Claims Tribunal awarded Rs 30,26,810 including a 30% enhancement for loss of future earning capacity. The insurer challenged this enhancement. The Supreme Court held that under the Constitution Bench decision in National Insurance Company Limited v. Pranay Sethi, a self-employed person aged 40-50 years should receive only 25% enhancement for future prospects, not 30%. The Court recalculated compensation at Rs 27,66,522 with 9% interest per annum, protecting claimants from recoveries of amounts already withdrawn.
