The Land Acquisition Officer awarded compensation at a lower rate, while the Subordinate Court later awarded Rs. 8,500 per Are to the appellant's father and brother for identically situated land under the same Notification. The appellant's Reference Petition was dismissed as barred by limitation. The Supreme Court held that since the lands were similarly situated in the same Survey and acquired under one Notification, the appellant is entitled to the same compensation rate as his family members, with full solatium, benefits, and interest, as the Reference Court erred in ignoring the uniform awards to his father and brother.
