N.D. Sharma & Ors vs Union of India & Ors

Bench: 3 — Anil R. Dave

In Brief

The Supreme Court addressed an appeal seeking enhancement of land acquisition compensation. Approximately 270 bighas of land were acquired under a single notification in 1987 for establishing a power house from three villages. The High Court had earlier awarded Rs. 32,951 per bigha for adjacent land in Iradat Nagar. Since all land formed one contiguous chunk acquired simultaneously for identical purposes, the Court held that uniform compensation was warranted and directed that Rs. 32,951 per bigha, plus statutory benefits, be awarded to all appellants. The appeals were allowed.
