The appellants, as tenants of a non-residential building in Telangana, challenged the landlord's application for rent enhancement after he purchased the property from the previous owner. The tenants argued the landlord had no authority to seek enhancement during an existing contractual tenancy. The Supreme Court held that Section 4 of the Telangana Building (Lease, Rent and Eviction) Control Rent, 1960 grants both landlords and tenants equal rights to apply for fair rent determination. A landlord is not precluded from seeking fair rent merely because a contractual tenancy exists; such provisions protect both parties' interests. The appeal was dismissed.
