A landlord in Latur sought eviction of a tenant from a commercial shop on grounds of non-payment of rent and denial of title. The Rent Controller ordered eviction, but the District Court and High Court reversed this, finding the tenant had deposited rent with the Rent Controller upon notice (hence not in default) and had justifiably questioned title due to a pending ownership dispute. The Supreme Court upheld these concurrent findings. Although dismissing the landlord's appeal, the Court modified the rent from ₹400 to ₹10,000 per month at the tenant's offer, allowing continued occupation.
