Najabhai Desurbhai Wagh vs Valerabhai Deganbhai Vagh & Ors

Bench: 2 — L. Nageswara Rao

In Brief

This case involved fourteen accused who attacked the complainant's house while armed with axes, iron pipes, and spears after a dispute over damage to an electric pole. A death resulted from the attack. The trial court convicted all under murder charges (Section 302 read with Section 149 IPC), but the High Court acquitted most, finding no common object to commit murder. The Supreme Court partly allowed the appeal, holding that while the accused could not be convicted under Section 302 with Section 149 IPC (as there was no prior concert to commit murder), they remained guilty under Section 326 (grievous hurt) read with Section 149 IPC, as their common object to attack the complainant was proved. The sentence was limited to time already undergone.">
