This civil appeal challenged the reversal by the High Court of a trial court's judgment regarding ownership of immovable property that formed part of a partition deed. The respondent claimed title to the property while the appellants claimed adverse possession. The Supreme Court held that the appellants cannot simultaneously claim title from 1976 and, after failing to establish title, advance adverse possession from the same date. The Court affirmed the concurrent findings of the lower courts that the property was HUF (Hindu Undivided Family) property and that the appellants failed to establish their possession as hostile, peaceful, open and continuous. The appeal was dismissed with costs, though the appellants were granted reasonable time to deliver possession.
