Narasus Coffee Company challenged criminal proceedings alleging violation of the Prevention of Food Adulteration Act, 1954, claiming the Public Analyst's report was served late and seized articles were not produced within statutory timeframes. The Supreme Court dismissed the petition, holding that a lower court had already recorded that the report was duly served on 12 December 2009. The Court ruled that once a subordinate court has determined such facts, the Supreme Court cannot re-examine the same issue under extraordinary writ jurisdiction, as doing so would constitute an abuse of legal process. The criminal trial must proceed in the Magistrate's Court.
