The appellant, a JBT teacher, applied for a No Objection Certificate (NOC) in March 2016 to participate in a Haryana Public Service Commission recruitment for Assistant Professor posts. Due to administrative delays, the NOC was issued only in June 2018, after court intervention. Though the appellant submitted the NOC before final appointments (made in July 2018) and scored higher marks than the selected candidate, the High Court refused to appoint him. The Supreme Court held this was grave error. It appointed the appellant while protecting the already-serving appointee (employed for three years) by accommodating him in another vacant Assistant Professor post.",
