Reshma Sultana vs The State of Karnataka & Ors

Bench: 2 — M.R. Shah, B.V. Nagarathna

In Brief

In this employment matter, the Supreme Court examined whether a High Court could direct the appointment of the original complainant after quashing a fraudulent appointment of another candidate to the post of Urdu Lecturer. The Court held that when an entire recruitment process is vitiated by fraud and manipulation, neither the fraudulently appointed candidate nor any other applicant from that tainted process can be appointed. Instead, a fresh selection process following proper procedure must be conducted. The Court confirmed the quashing of the appellant's appointment but set aside the direction to appoint the original writ petitioner, and instead ordered a new fair selection process to be initiated within three months under the Commissioner's supervision."
