An employee of Syndicate Bank was selected as Presiding Officer of the Debt Recovery Tribunal after obtaining the Bank's No Objection Certificate. He joined the new post directly without reporting back to the Bank, which later denied him pension claiming he breached service continuity rules. The Supreme Court held the Bank's stance unsustainable. The employee was on deputation when appointed, had sought permission from the Bank (which went unanswered for 11 months), and the Finance Ministry itself deemed the Bank's conduct inappropriate. The Court quashed the Bank's denial order and allowed the pension claim.
