Una Nagar Palika vs Kaliben Balubhai Makwana & Anr

Bench: 2 — Abhay Manohar Sapre

In Brief

Un Nagar Palika (a municipality) refused to pay pension to five retired employees, claiming they were ineligible. The employees sought mandamus from the High Court. The court held them eligible and entitled to pension. On appeal, the Supreme Court upheld the High Court's decision, finding the case covered by an earlier settled judgment (Chief Officer v. Mohamed Irshad Husenbhai Baloch). The Court held that municipal employees with 10+ years of service enrolled in the General Provident Fund are entitled to pension, regardless of whether directly appointed or transferred from a Panchayat. The municipality was directed to process and release pension within four months."
