In-service doctors challenged the counselling process for Post Graduate medical courses in Haryana, claiming they were denied weightage for service in remote and difficult areas. The State had failed to issue a fresh notification identifying such areas after the Supreme Court's prior order. The Court held that while the weightage provision for degree courses is discretionary, the 50% reservation for diploma seats for eligible in-service officers is mandatory. Without a formal list of remote areas, admission to 50% diploma seats was directed to be based on NEET merit among in-service candidates with three years' service and State clearance certificates, thereby implementing the statutory requirement despite administrative constraints.
