Naresh Chandra Bhardwaj vs Bank of India & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A bank officer challenged his removal from service for alleged misconduct causing financial loss. Two similarly situated officers who caused comparable or greater losses were instead given the lesser punishment of compulsory retirement. The Supreme Court held that equality and parity principles require similarly situated officers receive equal treatment. Since the appellant's loss was less severe and his involvement more limited than the other officers, he was entitled to the same compulsory retirement rather than removal from service. The appeal was allowed.
