Naresh vs State of Madhya Pradesh

Bench: 2 — Kurian

In Brief

Naresh was convicted under Section 325 IPC (voluntarily causing hurt) and sentenced to one year imprisonment and Rs. 3,000 fine. The High Court upheld this sentence. On appeal to the Supreme Court, the Court found that the counterparty in the same incident had received a lighter sentence (imprisonment till rising of court) in a National Lok Adalat, and that both parties had since settled their dispute with no law and order problems. The Court modified the sentence to the period already undergone and ordered the appellant's release.
