Naresh was convicted under Section 325 IPC (voluntarily causing hurt) and sentenced to one year imprisonment and a fine of Rs. 3,000. The High Court upheld this sentence. On appeal to the Supreme Court, it emerged that the co-accused in the same incident had received a lighter sentence—imprisonment only till the rising of the court in a National Lok Adalat. The Court found that the parties had since settled and there was no law and order problem. Holding that parity of punishment was relevant and reconciliation had occurred, the Court modified the sentence to time already served and ordered the appellant's release from jail.
